Terms of Service
1. Who these Terms are between
These Terms are an agreement between you and:
- [إظهر: الكيان القانوني تحت التأسيس / Ezhar, legal entity to be registered]
- Commercial register: [TBD]
- Tax ID: [TBD]
- Registered address: [TBD]
- Contact: support@ezhar.io
"You" means the player using the app. Where the player is under 18, "you" also means the parent or legal guardian who agreed to these Terms on the player's behalf, and that guardian is responsible for the account. By tapping to accept at sign-up, or when claiming a profile we created for you, you agree to these Terms and confirm you have read the Privacy Policy.
2. What Ezhar is
Ezhar is a platform that assesses young footballers and shows their profiles to football clubs and academies. Depending on how you joined, it does some or all of the following:
- Filming you performing standard drills at an assessment session we run, or letting you record and upload those drills yourself.
- Analysing those videos automatically to produce scores.
- Publishing your profile and scores inside the Ezhar platform, where staff at approved clubs and academies can find you.
- Letting you apply to trials and assessment sessions, and letting clubs invite you to them.
3. Who may use Ezhar
- You must be at least 13 years old.
- If you are under 15, your parent or legal guardian must give consent before the account is created, and the account is held under their responsibility.
- If you are 15 to under 18, you may agree yourself or your guardian may agree for you; we still record guardian contact details.
- One account per person. The phone number on the account must be one you or your guardian control.
- You must give us true information. Your name and date of birth become locked once age verification begins, precisely because age decides which age group you compete in. Giving a false age is grounds for removing your account and voiding any result.
4. Your account
You are responsible for keeping your password and your phone secure. Sign-in uses a one-time passcode sent to your phone; do not share that code with anyone, including anyone claiming to be from Ezhar. Tell us immediately at support@ezhar.io if you think someone else has got into your account.
5. Claiming a profile we made for you
If we filmed you at an assessment session, we created a profile for you and sent you a link or a code to claim it. Claiming means confirming your phone number by passcode and accepting these Terms and the Privacy Policy, exactly as a new sign-up does.
- The name and date of birth recorded at the session stay as recorded, because we checked them against your identity document there. Tell us if something is wrong and we will correct a genuine error.
- The videos we filmed of you become part of your profile when you claim it.
- If you do not claim your profile, tell us and we will delete it.
6. Your videos and what we may do with them
Your videos are yours. You keep ownership of them.
By uploading a video, or by being filmed at one of our sessions with the consent described above, you give Ezhar permission to store it, analyse it, and show it inside the Ezhar platform to the clubs and academies described in the Privacy Policy, for as long as your account is open. This permission exists so we can run the service; it is not a transfer of ownership and we do not gain the right to sell your footage.
What you upload must be yours. Do not upload footage of other people without their permission, footage you do not have the rights to, or anything abusive, misleading, or unlawful. We may remove anything that breaks this and, for serious or repeated cases, close the account.
7. Scores and how to read them
Scores come from software analysing your movement, and they are estimates, not measurements of your worth as a footballer. Poor light, a shaky camera, a wrong camera angle or an unusual pitch can all affect a result. Scores carry a confidence marker and we tell you when a result is low-confidence.
We do our best to be accurate, but we do not guarantee that any score is correct, and a score is not a professional assessment of your ability or your fitness. No club decision is made by software alone; a person at a club makes it.
If you think a score is wrong, ask us and we will look at it. Where the rules allow it you can re-record the drill; if a video is rejected by our system, that attempt is returned to you.
8. Clubs, and what paid access means
Clubs and academies pay Ezhar for access to the player database. That is how we fund the service. You should know what that does and does not mean for you:
- A paying club can browse profiles, scores and videos, filter by position and age, and shortlist players. This includes your profile once it exists, whether or not you applied to that club.
- A paying club does not automatically get your phone number. Your contact details are released to a club only where you, or your guardian if you are under 18, have separately opted in, and you can withdraw that at any time.
- A club may use what it sees only to assess and recruit players for itself. It may not resell it, republish it, or pass it to a third party. That is a condition of its contract with us and we cut off access for breaking it.
- Ezhar takes no fee from you if a club signs you, and we take no share of any contract you sign with a club. Any agreement between you and a club is between the two of you; we are not a party to it and we are not responsible for it.
9. Fees, payment and refunds
Some parts of Ezhar cost money: an assessment session seat, or a trial fee set by the club running it. Where a fee applies, the amount in Egyptian pounds is shown before you pay. Payment is taken through PayTabs; we never see your card details.
- Cancel before the session takes place and you get a full refund.
- If you attend and the session goes ahead, the service has been delivered.
- If we cancel a session, move it to a date you cannot make, or cannot deliver your results, you get a full refund whether or not the 14 days have passed.
- If your video cannot be scored for a reason that is our fault, you get another attempt at no charge, or a refund if you prefer.
Fees do not buy a result. Paying for a session pays for the assessment. It does not buy a score, a ranking, a trial invitation, or any interest from a club. Where the law gives you a stronger right than this section does, the law applies.
10. Fair use
Do not: create accounts for other people without their permission; upload someone else's footage as your own; try to change or fake a score; attack, scrape or overload our systems; try to reach data that is not yours; use Ezhar to harass or endanger anyone; or use Ezhar for anything illegal.
We may suspend or close an account that does these things. Where a suspension is our mistake we will restore the account.
11. Ending the agreement
You can stop using Ezhar at any time and ask us to delete your account, as described in section 14 of the Privacy Policy.
We may suspend or close your account if you break these Terms, if we are required to by law, or if we reasonably believe it is necessary to protect a child. Except where the situation is urgent or serious, we will tell you why and give you a chance to respond. If we close your account for our own reasons and not because of anything you did, we refund any fee you paid for a service you have not yet received.
If we ever stop running Ezhar, we will give you reasonable notice, let you download your videos and results, and delete what remains.
12. Our responsibility
We provide Ezhar with reasonable care and skill, but we do not promise the app will always be available, error-free, or uninterrupted. Assessment sessions depend on weather, venues and equipment.
Nothing here limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything Egyptian law does not allow us to limit, including your rights as a consumer, which these Terms do not reduce.
Subject to that, we are not responsible for a club's decision not to select you, for anything a club does after it contacts you, for a result you consider disappointing, or for loss you could not reasonably have expected. Where we are liable for a paid service, our liability is limited to refunding what you paid for it.
13. Safety
If you are at an assessment session, follow the assessor's instructions. Do not take part if you are injured or unwell. Warming up properly is your responsibility, and where you are under 18 it is your guardian's. If you have a medical condition that makes physical testing risky, tell us before the session.
If you feel unsafe, or if anyone on or through this platform behaves toward you in a way that worries you, contact us at support@ezhar.io immediately.
14. Changes to these Terms
We may update these Terms. If a change materially affects your rights, we will tell you in the app and ask you to accept the new version before you carry on using Ezhar. The version you accepted is recorded on your account. If you do not accept a new version, you can close your account and, where you have paid for something you have not yet received, get a refund for it.
15. Language, law, and disputes
These Terms are written in Arabic and English. The Arabic text is the authoritative one. These Terms are governed by the laws of the Arab Republic of Egypt, and the Egyptian courts have jurisdiction over any dispute. Nothing here takes away your right to complain to the Consumer Protection Agency or to the Personal Data Protection Centre.
